February 1, 2021 Letter:
Letter from the AGs office pertaining to the assessment of Crime Lab Fee (CLF) fund monies. Based on O.C.G.A. § 42-8-34 and the Clerks' Authority's Rule and Regulation 1.15, CLF is assessed once per case and does not require a fines to be assessed. If a case has multiple counts subject to CLF and fines are assessed on multiple counts, then a case is defined as a count and CLF applies to all counts where a fine is imposed.
House Bill 576 (HB 576)
Passed during the 2020 legislative session, this bill modifies O.C.G.A. § 15-6-95 changing the partial payment priority schedule for Superior Court. Also, the bill became effective upon the Governor's signature or when it becomes law without such approval. This bill has an effective date of August 3, 2020.
Senate Bill 249 (SB 249)
Passed during the 2020 legislative session, this bill modifies O.C.G.A. § 47-17-60 changing the assessment and calculation of Peace Officers' Annuity & Benefit Fund, POAB, for fines, bonds, and pretrial diversion fees. Affecting all courts, POAB is modified to be (1) a surcharge that is the greater of $10 or 10% of each fine, (2) a deduction that is the greater of $10 or 10% of each bond forfeited, and (3) a deduction that is the greater of $5 or 5% of each pretrial diversion fee. The bill has an effective date of July 1, 2020.
